Terms and Conditions

"AGV Racing" or "agvracing.com" disregarding capitalization, spacing, or punctuation are all in reference to the company and its website on which these terms and agreements appear.

By making a purchase from AGV Racing (Either Telephone or Online), customers agree to all terms stated below. All customers ordering from AGV Racing also agree that they (you, the buyer) or anyone else will not issue a charge back and all settlements be done outside the jurisdiction of any credit card company.

AGV Racing staff takes care of our customers and their needs to ensure a safe transaction for both the buyer and the seller. Due to the fact that we sell aftermarket car parts, our policies may seem strict so we suggest that when buying parts you research everything about them and have them installed by a professional as most parts on our website are considered custom installs. We offer several methods to contact our customer service department to have any questions or concerns answered prior to placing an order. So if you do not agree with our terms, we suggest you purchase your parts elsewhere.

CONDITION OF SALE - All sales are final and all products sold by AGV Racing are sold "AS-IS" to the buyer. Please place your order carefully and double check that you are ordering the correct product for your vehicle! Or call us at 1-301-633-2096 to confirm that you are about to order the correct part prior to placing the order. Once an order goes out, it is very difficult for us to take the item back simply because of the customers error.

All orders placed by customers, disregarding credit/debit card limits, will be processed and charged. AGV Racing or processing companies will not be held liable for overdraft charges incurred to customers from placing orders. Please do not place orders for items you know you cannot afford on a payment method.

You also agree that you will NOT issue charge backs (whether it be by VISA®, MasterCard®, American Express®, Discover®, or any other debit/credit card) against AGV Racing, and everything be dealt with directly through AGV Racing or its staff to come to a resolution.

PRICING - All prices listed on our website, advertisement, and/or catalog do not include shipping & handling charges. All prices and descriptions are subject to change without notice. Orders shipped to Maryland residents must include 5% sales tax.

WARRANTY/LIABILITY - All products sold by AGV Racing are only subject to the manufacturer's warranty. Manufacturer's warranty will not be honored if the defect is the result of customer's mishandling, abuse, or faulty installation. AGV Racing gives no warranties, expressed or implied, including, but not limited to, the implied warranties of merchantability, and fitness for a particular purpose. AGV Racing will not be held liable for any damages that are incurred directly or indirectly on the vehicles or operators or passengers of the vehicle.

ORDER ACCEPTANCE - Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. AGV Racing reserves the right at any time after receipt of your order to accept or decline your order for any reason. AGV Racing reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item and adjust your invoice accordingly. AGV Racing may require additional verifications or information before accepting any order (e.g. additional vehicle info / contact information).

ORDER CANCELLATION - Any order that is cancelled with AGV Racing after 24hrs from placement of order to the time of shipment will be subject to a cancellation fee of 5%. Cancelled orders are subject to a restocking fee up to 25% of the original purchase price. Special order items may not be cancelled or returned. Orders may not be cancelled once they have been shipped. AGV Racing must approve all other returns prior to being returned.

SPECIAL ORDERS - AGV Racing will determine special order items. All special ordered items must be prepaid before processing your order. Special ordered items cannot be cancelled or returned.

NOTE ABOUT RETURNS - AGV Racing reserves the right, before and/or after receiving your product(s), to refuse any returns, exchanges and cancellations. Please remember that most items cannot be returned unless AGV Racing shipped the wrong item or if a staff member of AGV Racing was at fault. In these rare cases, please contact us so we can immediately resolve the issue.

If it is found that AGV Racing is not at fault and the item is still in brand-new condition, AGV Racing can accept it as a return but a restocking fee to cover charges of shipping, boxing, labor and legal work will be deducted from the total cost of the part.

Shipping charges cannot be refunded under any circumstances. AGV Racing reserves the right to charge all/every fee(s) for violation of one of any of these policies. In any case of approved returns/exchanges, shipping charges are NOT refundable. Please remember that shipping costs go to the shipping company, and not to AGV Racing, hence it is out of our control and we cannot reimburse you money on behalf of the shipping company.

AUTHORIZED MERCHANDISE RETURNS - You must call our customer service department to receive approval on a return. All items sold are BRAND NEW and "AS-IS." All rights reserved by AGV Racing to accept or reject returns, only upon certain and specific conditions. All items subject up to a 25% restocking fee. We accept absolutely no returns 10 days after purchase. ALL RETURNED MERCHANDISE MUST RECEIVE PRIOR APPROVAL FROM AGV Racing and must have a valid (RMA#) Return Merchandise Authorization Number which you can only receive by calling and speaking to a customer service representative.

All authorized returns must be returned within 10 days after being delivered. Any items received after 10 days or without approval from AGV Racing will be refused and returned to the purchaser at his/her own expense. All returns must be in unused, unaltered, and unpainted condition.

All returns must be sent shipping prepaid. AGV Racing will refuse any returns sent freight collect and will return the packages to the purchaser at their own expense. All returnable items must be carefully packed in original packing (or better) if the original packing is no longer in good condition. Purchaser is advised to insure the returned goods for their full value for their own protection, since neither AGV Racing nor the shipping company would be responsible for any damage or loss in shipment.

Refunds will not be issued on returned merchandise damaged on the way back to AGV Racing. It is the buyer's responsibility to insure the returned shipment. In the event returned merchandise is damaged, AGV Racing will file a claim with the carrier and refund the purchaser upon settlement of the claim.

REJECTED SHIPMENTS/UNAUTHORIZED MERCHANDISE RETURNS - Any item(s) REJECTED or SENT BACK to AGV Racing without a RMA number referenced are considered an UNAUTHORIZED return. If the rejection or return of a package is not authorized, the buyer will be charged a 25% fee of the BASE price, separate from the 20% restocking which may or may not be applied for cancelled orders.

SHIPPING DAMAGE - Damage may occur occasionally in transit. The carrier insures the shipments and insurance is included on the standard freight quotes. Any damage in shipment is the responsibility of the carrier; therefore the purchaser must make all damage claims directly to the carrier. In case of damage, retain all cartons, packing materials and damaged merchandise for the carrier to inspect. If the damage is apparent upon receipt, reject the package and note to the driver that it is damaged. A new part will then be shipped, and AGV Racing can then handle the insurance claim.

If you sign and accept the package, it is out of our hands and can no longer be handled by our company, so please inspect all packages carefully! All parts must be inspected before the driver leaves or else claims can be denied by the transit freight company. If any damage has occurred, note it on the driver's bill and have him initial it and make a copy for your records. All disputes as to the settlement amount or manner should be addressed with the carrier. AGV Racing under no circumstances shall be liable for the damage merchandise or for subsequent settlement of the claim with the carrier. We ship the merchandise, but we don't deliver it. Please be reasonable in your requests.

BODYKITS/SPOILERS - Buyer fully understands that all body kits and spoilers are sold "AS-IS" with no warranty. All our body kits are carefully packaged and boxed, but once in a while, damage may occur while shipping. AGV Racing is responsible only for the shipping out of the product, and any damages must be reported to the shipping carrier. All our body kits are shipped with insurance for this matter. Buyer also understands that due to strict U.S. Federal and State Safety crash guidelines, AGV Racing is not responsible or liable for any damage or possible injury incurred upon possible accidents due to driver error, incorrect installations, bad judgment (cracking or breaking your parts). Buyer understands that all body kits/spoilers may need modifications for correct fitment such as removal of safety reinforcements, removal of factory bumper lights/side marker indicators, shaving, molding, etc. Since many of these kits are prototyped and used on non-USA vehicles that have much less safety standards/requirements in their respective countries of origin, AGV Racing is not liable for any illegal street use of these parts. Body kits require some prep work before painting and professional body shop installation is highly recommended. Body kit orders are not like typical products; they are hand crafted and engineered. If backordered or not in stock, AGV Racing has no choice but to charge a 15% reversal transaction fee (of the total price) to cover charges of refund and accounting, if you decide to cancel your order. Please do not try and "dispute" this 15% fee because it is out of our hands and not in the jurisdiction of AGV Racing to waive it.

Fiberglass body kits are sold "AS-IS" and it is the customer's responsibility to know all of the work involved in the installation process. Please understand fiberglass kits are not always direct bolt-ons. Sometimes it is possible a fiberglass kit may need prep work including filling gaps, trimming, or grinding. AGV Racing recommends that the retail customer seek an experienced custom shop to do the install on body kits and choose a body man who is familiar with all the procedures of installing fiberglass kits. We do not recommend a collision shop to do installs on body kits, they are only experienced on installing OEM parts that are direct bolt-on and do not know the procedure of installing aftermarket body kits.

FIBERGLASS/ CARBON HOODS - Buyer fully understands that all fiberglass and carbon fiber hoods or hoods in general that are sold by AGV Racing are sold "AS-IS" with no warranty expressed or implied. All hoods are made for track use only and not legal on public highways or streets. Buyer also understands that due to strict U.S. Federal and State Safety crash guidelines, AGV Racing is not responsible or liable for any damage or possible injury incurred upon possible accidents due to driver error, incorrect installations, bad judgment (cracking or breaking your parts). We strongly recommend Hood Pins for safety reinforcement. Buyer understands all Hoods are aftermarket parts and have no OEM specifications whatsoever. Hoods may require some prep work and modifications before painting and installation - professional body shop installation is highly recommended.

CLAIMS - Claims for defective goods, shortages, delays, or failures in shipment or delivery, or for any other cause, shall be deemed waived and released by buyer, unless made in writing within five (5) days after the arrival of the goods.

PART LEGALLIITY AND ROAD USE - *WARNING* All parts sold by AGV Racing except for street legal/DOT approved parts, are racing parts for off road use only. Federal and many State laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting the vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the warranty coverage, if any, on your vehicle. AGV Racing shall not be liable for any special, direct, indirect, incidental or consequential damages that might be claimed as a result of the failure of any part, including claims for delay, loss of profits, or labor. AGV Racing shall not be liable for any damage or injury to persons or property resulting from improper installation or misuse of any part. AGV Racing will not cover any loss in profit or labor due to errors in shipping, mispackaging, and/or extended delays for backorder items. AGV Racing shall not be held accountable for any misconception or disappointment associated with any product.

PERFORMANCE PARTS - AGV Racing does engage in selling after-market items, and the Buyer does understand the ramifications for having these performance or after-market parts on a vehicle. AGV Racing is not held responsible for any misconception or disappointments associated with any of these parts. Check your local state laws regarding engine, exhaust, performance, body kits, racing hoods, and modification parts as they may not be legal in your state for street use and may be for off-highway use only!

PART INSTALLATION - When receiving your order, be certain you received exactly what you ordered. Remember that if you use, paint, or modify parts ordered in any way, you will take over full liability for the part(s). Any returns after a part has been removed from the box and fitted will be denied. Any aftermarket part that is not a direct bolt on such as body kits, hoods, fenders, scoops, vertical doors, etc. require modification for installation. Modifications may include painting, shaving, cutting, prepping, sanding, etc. This work needs to be done by a trained professional or an experienced body shop.

SITE SUBMISSIONS - By submitting your creative ideas, inventions, suggestions or materials (your "submission") you grant AGV Racing a royalty-free, perpetual and irrevocable, license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display your submission (in whole or in part) worldwide and to incorporate your submission in other works in any form, media, or technology now known or later developed without any notice or compensation to you.

FRAUDULANT/UNAUTHORIZED ORDERS - All "scam artists" using fraudulent credit card, identity theft etc will be subject to FULL prosecution by law. If you are ordering from agvracing.com, regardless of a stolen or unauthorized payment or identity, you agree that AGV Racing rightfully can and will sue/press charges against you and your immediate family members who actively participated in the fraudulent activity, without your families objection in the court of law. If the person placing the fraudulent order is under the age of 18, we will sue the individual's parents to cover any fees and legal costs associated with the transaction unless the individual are legally responsible for himself or herself. Please see JURISDICTION for more information.

Anyone tampering with the shopping cart and/or payment devices and systems physically or electronically on www.agvracing.com and its sub-pages are subject to fine, by AGV Racing to compensate for this abuse. AGV Racing reserves all rights to determine how much is to be returned for this type of abuse.

AGV Racing and all in/out house attorneys WILL pursue all fraudulent and illegal activities brought upon, either directly or indirectly, to "AGV Racing." Including, but not limited to, credit card fraud, identity theft, misleading information, and any/all illegal activities deemed so by the state of Illinois, and or presiding states. Do not use stolen or fraudulent credit cards on agvracing.com under penalty of severe legal action. AGV Racing reserves the right to decline or cancel any orders for any reasons.

CATALOG ERRORS - In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from the supplier or manufacturer, AGV Racing shall have the right to refuse or cancel any order placed for product listed at the incorrect price. AGV Racing shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, AGV Racing shall issue a credit to your credit card account in the amount of the charge.

COPYRIGHT & TRADEMARK - All content included on this site, such as text, graphics, logos, button icons, images, audio clips and software, is the property of AGV Racing or its suppliers and protected by U.S. and international copyright laws. All trademarks, service marks, and trade names are proprietary to AGV Racing. All other trademarks not owned by AGV Racing or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by AGV Racing. Any unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. All logos, trademarks, pictures and any and all items are property of their rightful owner(s). AGV Racing does not endorse or have affiliation/connection to any of company names and logos used.

LIMITATION AND LIABILITY OF DISCLAIMER - The AGV Racing website (www.agvracing.com) and the materials therein are provided "AS-IS". AGV Racing makes no representations or warranties, either express or implied, of any kind with respect to the operation, contents, information, or materials contained therein. You agree that AGV Racing, its directors, officers, employees or other representatives shall not be liable for damages arising from the operation, content or use of the AGV Racing website. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages. AGV Racing shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, AGV Racing shall immediately issue a credit to your credit card account in the amount of the incorrect price. AGV Racing and/or all affiliates and distributors will not be held responsible for injury/death due to misuse of items sold.

JURISDICTION - You, the buyer agrees that any legal action brought against/from AGV Racing shall be governed by the laws of the State of Maryland without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on AGV Racing shall be an appropriate federal or state court located in Montgomery County in the State of Maryland.
